Wenn es nicht schon vorher zum Erwerb eines Dritten vom Nichtberechtigten gekommen ist (§§932 ff. BGB), findet der Verfall als Vorgang in der Zeit statt. Dem nicht besitzenden Eigentümer rinnt sein Eigentum durch die Finger. Die Zeit kann akquisitiv wirken. Der Zerfall geschieht rückstandslos, wenn ein Dritter durch Ersitzung eigenes Eigentum geriert. Aber auch wo es nicht zur Ersitzung kommt, erodiert das Eigentum. Denn die Zeit wirkt extinktiv. Der Herausgabeanspruch aus dem Eigentum verjährt. Andreas Bergmann spürt diesen, teils äußerst komplizierten Zusammenhängen am Beispiel von NS-Raubkunst und sogenannter "Entarteter Kunst" nach.
