Schwerpunkt ist die anschließende umfassende Untersuchung der im OECD-Musterkommentar 2008 eingeführten Tatbestandsalternative einer echten Dienstleistungsbetriebsstätte. Neben einer dogmatischen Einordnung erfolgt eine Betrachtung der Tatbestandsmerkmale der Alternativvorschrift unter besonderer Berücksichtigung praxisrelevanter Konstellationen und möglicher Implikationen für das nationale Steuerrecht Deutschlands de lege lata et de lege ferenda.
