Der Staat verfügt damit über einen enormen Informationsschatz. Viele der Daten sind allgemein zugänglich, geregelt durch das 1994 in Kraft getretene Umweltinformationsgesetz, die Informationsfreiheitsgesetze von Bund und Ländern sowie das Verbraucherinformationsgesetz. Kehrseite der Medaille: Die Herausgabe von Informationen kann die Rechte Dritter an z. B. geistigem Eigentum berühren. Entstehung und Ausübung dieser Rechte werden damit in Frage gestellt. Frank Perwin grenzt diese Problematik juristisch ein, bewertet deren Reichweite und schildert die erhebliche Bedeutung der Thematik auch aus ökonomischer Perspektive: Schließlich sind gerade geistige Errungenschaften wie Produktzusammensetzungen, Herstellungserkenntnisse oder Vertragsdetails das eigentliche Kapital eines Unternehmens oder einer Person.
