Die Thematik der Gesellschafterfremdfinanzierung ist sowohl von erheblicher praktischer Bedeutung als auch von hoher Aktualität. Sie spielt in jedem Körperschaftsteuergesetz eine Rolle und berührt das nationale, internationale und europäische Steuerrecht. Ausgehend von einem historischen Abriss zur Entwicklung der Problematik in Deutschland behandelt die Arbeit vielfältige Probleme des § 8a KStG in der Fassung des Korb II-Gesetzes. Die Regelung war die Reaktion des Gesetzgebers auf die Entscheidung des EuGH in der Rechtssache Lankhorst-Hohorst und wirft erneut die Frage nach ihrer Vereinbarkeit mit Europarecht auf. Nach einer europarechtlichen Prüfung des Gesetzes vor dem Hintergrund der aktuellen Rechtsprechung des EuGH werden alternative Regelungskonzepte analysiert. In diesem Rahmen findet die zum 1.1.2008 eingeführte Zinsschranke Berücksichtigung. Ein Reformvorschlag vervollständigt das Werk.
