Der strafrechtliche Schutz von Kennzeichen hat jedenfalls eine lange Tradition. Nachdem das Markenstrafrecht jahrelang nur ein Schattendasein geführt hat, gewinnt es seit dem Aufkommen der Markenpiraterie immer stärker an Bedeutung. Bernhard Böxler geht daher der Frage nach, ob und in welchem Umfang der strafrechtliche Schutz von Marken und anderen Kennzeichenrechten sachlich gerechtfertigt ist. Weitere Schwerpunkte bilden die erstmalige eingehende Untersuchung der geschichtlichen Entwicklung des Markenstrafrechts sowie die Analyse seiner zivilrechtsakzessorischen Ausgestaltung und der durch diese bedingten Probleme. Der Autor legt dar, dass das geltende Markenstrafrecht einer restriktiven Auslegung bedarf und spricht sich de lege ferenda für eine Konzentration auf Kernverstöße aus.
