Die Problematik stellt sich für nicht mehr geschützte Kunstwerke, Kennzeichen, Erfindungen und Persönlichkeitsrechte. Sind also z.B. Bezeichnungen wie Johann-Sebastian-Bach-Sekt oder Mona-Lisa-T-Shirt als Marken schutzfähig? In der Literatur wird ein markenrechtlicher Schutz derartiger Zeichen tendenziell skeptisch gesehen. Demgegenüber vertritt Ina Haarhoff eine markenschutzfreundlichere Grundposition, die sie mit zahlreichen Beispielen illustriert.
