Der Autor untersucht mit rechtssoziologischen Methoden, ob in Zivilprozessen von den Gerichten Druck auf die Rechtsuchenden ausgeübt wird, einen Prozeßvergleich abzuschließen. Nach einer Darstellung des sozialwissenschaftlichen Hintergrunds, einer Analyse der Interessen der Prozeßbeteiligten und der Auswertung der Rechtspflegestatistiken stellt der Autor die Resultate einer eigenen Untersuchung dar, welche er im Jahre 1994 in der Schweiz im Kanton Zürich durchgeführt hat. Er gelangt dabei zum Schluß, daß es nicht in erster Linie das richterliche Verhalten, sondern daß es die institutionellen Druckfaktoren wie Kosten, Verfahrensdauer und vor allem die aus der richterlichen Doppelrolle von Richter und Vermittler resultierende Urteilsdrohung sind, welche Vergleichsdruck erzeugen.
