Eugen Paschukanis Werk Allgemeine Rechtslehre und Marxismus, 1929 erstmals auf Deutsch erschienen, ist einer der bedeutendsten Entwürfe einer auf Marx gestützten Kritik des Rechts. Denn Paschukanis machte als erster die Marxsche Basiskategorie der Ware für eine kritische Rechtstheorie fruchtbar. Dabei bestimmt er das Recht der bürgerlichen Gesellschaft als Recht par excellence, indem er den modernen Rechtstypus auf die gesellschaftlichen Strukturen des Kapitalismus zurückführt. Paschukanis dechiffriert die für ihn zentralen Begriffe Rechtssubjekt und Rechtsverhältnis als Kategorien der warenproduzierenden Gesellschaft und kritisiert so unterschiedlichste 'bürgerliche' Rechtstheorien in ihren Axiomen. Schließlich entwickelt er ein Modell der Rechtssubjektivität, an welches zur Reformulierung einer materialistischen Rechtstheorie angeknüpft werden kann.§§Harms beleuchtet nicht alleine das durchaus widersprüchliche Leben und Werk Paschukanis', sondern gibt einen Überblick über die Rezeption und damit über die Geschichte kritischer Rechtstheorie.
