Lehre und Rechtsprechung haben sich bis anhin nur vereinzelt mit dieser Frage beschäftigt; Schranken werden dabei in erster Linie aus der persönlichen Freiheit abgeleitet. Der Autor knüpft an dieser Praxis an; untersucht aber auch, inwieweit die ideellen Grundrechte der Bearbeitung von Personendaten Schranken setzen. Einen weiteren Schwerpunkt bildet die Untersuchung der verfassungsrechtlichen Anforderungen an die Normierung und das Verfahren der Bearbeitung von Personendaten; dabei wird insbesondere auch der verfassungsrechtliche Rahmen abgesteckt, in den sich allgemeine Datenschutzgesetze einzufügen haben.
